The first North American patent was granted to Samuel Winslow in 1641 by the Massachusetts General Court for a new process of making salt. In 1790, the first congress adopted a Patent Act, under which the first US patent was issued to Samuel Hopkins for a potash production technique. A patent owner does not necessarily have the right to use the invention, but the patent does provide the patent holder the right to exclude others from using it.
